Understand the rules, rights, responsibilities, and safe-use standards that guide activity across Big-Teal.
As used in these Guidelines, the terms "we", "us", or "Big-Teal" means Big-Teal Services or any of its affiliate companies, and "you" means the user using our service. Strict compliance with these Guidelines is required at all times.
These Terms of Service form a binding agreement between you and Journcart, including the Journcart website, marketplace, store dashboard, buyer tools, seller tools, messaging tools, order tools, quotation tools, auction tools, deal tools, event tools, promotional tools, CRIB account tools, payment and withdrawal flows, help pages, and related services that link to these Terms.
By creating an account, browsing the marketplace, opening or managing a store, listing a product, placing an order, making a bid, requesting or issuing a quotation, sending a message, uploading content, creating an event, buying a promotion, using a CRIB account, requesting a withdrawal, submitting support information, or otherwise using the Services, you confirm that you have read, understood, and agree to these Terms.
You may use the Services only if you are legally able to enter into binding contracts. If you use the Services for a company, store, church, organisation, partnership, or other entity, you confirm that you have authority to bind that entity and its authorised users to these Terms.
If you do not agree to these Terms, you must not use the Services. Journcart may refuse, suspend, limit, or terminate access where required for legal, security, payment-risk, fraud-prevention, marketplace-safety, or policy-enforcement reasons.
Where these Terms refer to Journcart, they refer to the platform operator and any authorised team, administrator, service provider, or affiliate acting on its behalf. For production use, replace Journcart with the registered legal name of the platform operator wherever a specific contracting entity is required.
Journcart provides marketplace technology that helps buyers discover products and stores, helps sellers operate online shops, and helps users communicate, request quotations, place orders, bid in auctions, manage events, promote listings, arrange payments, and track transaction records.
Unless Journcart is expressly identified as the seller, the sale contract for a product or service is between the buyer and the seller. The seller is responsible for the listing, price, stock availability, product legality, product quality, product safety, description, delivery obligations, warranty information, return policy, tax obligations, and after-sales support.
Journcart may facilitate checkout, messaging, payment processing, order tracking, settlement, dispute handling, refunds, notifications, store management, and policy enforcement. Providing these tools does not automatically make Journcart the seller, courier, insurer, manufacturer, importer, employer, agent, or guarantor of a third-party listing.
Users must exercise reasonable care before transacting. This includes reviewing product descriptions, photos, quantities, variations, conditions, measurements, prices, shipping methods, delivery estimates, seller information, store ratings, messages, quotation details, and order summaries.
Journcart may delay, cancel, reverse, restrict, hide, delist, or review a transaction where it reasonably suspects fraud, policy breach, payment risk, legal risk, safety risk, sanctions risk, mistaken pricing, technical error, unauthorised activity, or abuse of marketplace tools.
You are responsible for providing accurate, complete, and current account information, including your name, contact details, country, region, store details, billing details, delivery details, and any verification information requested for account, store, payment, withdrawal, promotion, or support purposes.
You must keep your login credentials, device access, PINs, payment credentials, CRIB account credentials, and verification information confidential. Activity performed through your account may be treated as authorised unless you promptly notify Journcart of suspected compromise and Journcart determines otherwise.
Journcart may require identity, business, location, phone, email, tax, ownership, licence, delivery, banking, mobile money, CRIB account, or other verification before enabling certain features such as store creation, product uploads, auctions, promotions, payment acceptance, wallet use, withdrawals, refunds, or seller verification badges.
Verification badges, labels, ratings, account checks, and store checks are trust indicators only. They do not guarantee identity, solvency, product quality, safety, legality, stock availability, delivery performance, or future conduct.
You must not create accounts using false information, impersonate another person or business, operate an account without authority, transfer your account without permission, interfere with another account, or use multiple accounts to avoid limits, penalties, fees, bans, reviews, or enforcement action.
Store owners must ensure that store names, URLs, logos, banners, contact information, websites, descriptions, categories, product categories, business details, store accounts, subscription choices, and public store information are accurate, lawful, and not misleading.
A store subscription, product allowance, promotion, verification label, template, event feature, auction feature, or seller tool may be limited by package, country, currency, account status, subscription expiry, marketplace policy, verification status, stock availability, or technical capacity.
Store owners are responsible for all actions taken by people they allow to access or manage the store. This includes product uploads, price changes, shipping settings, messages, quotations, auctions, deals, events, promotions, order management, refunds, withdrawal requests, and customer support.
Journcart may hide, restrict, delist, pause, or close a store that appears inactive, expired, unpaid, misleading, unsafe, unlawful, fraudulent, abusive, or harmful to buyers, sellers, the platform, payment providers, delivery providers, or the public.
Store tools are provided to support seller operations. Sellers remain responsible for keeping adequate records, complying with applicable business licensing and tax requirements, honouring confirmed orders, handling customer communications professionally, and meeting any product-specific legal obligations.
Sellers must ensure that each listing is accurate, complete, lawful, and not misleading. A listing should clearly describe the product name, category, condition, price, currency, quantity available, minimum and maximum order quantities, variations, containment or package contents, attributes, product descriptions, images, videos, delivery options, warranty information if any, and material defects or risks.
Sellers must list only items they own, control, are authorised to sell, or can lawfully supply. Sellers must promptly update or remove listings where stock, price, condition, shipping options, product details, or legal availability changes.
Product photos, videos, brand references, descriptions, dimensions, colours, specifications, and variations must represent the actual item or clearly disclose when they are examples. Sellers must not use misleading images, hidden defects, false scarcity, fake discounts, keyword stuffing, or false brand associations.
Prices, discounts, deals, and old prices must be genuine and must not mislead buyers. Where taxes, duties, delivery fees, installation fees, service charges, customs fees, or other charges are not included in the product price, the seller should disclose them clearly where known.
Journcart may edit formatting, require corrections, demote, disable, remove, or reject listings that are inaccurate, incomplete, duplicated, unsafe, unlawful, infringing, restricted, spammy, abusive, technically broken, or inconsistent with marketplace standards.
You must not list, buy, sell, promote, request, ship, or facilitate items or services that are unlawful, unsafe, stolen, counterfeit, infringing, deceptive, hazardous, abusive, exploitative, or otherwise prohibited by Journcart policy or applicable law.
Restricted or prohibited items may include counterfeit goods, stolen goods, illegal drugs, controlled substances, unlicensed medicines, unsafe food or cosmetics, weapons, ammunition, explosives, hazardous chemicals, endangered wildlife products, fraudulent documents, hacking tools, malware, spyware, adult exploitation material, hate or extremist goods, and any item requiring licences or approvals that the seller does not hold.
Sellers of regulated goods or services are responsible for obtaining and maintaining all required licences, permits, certifications, age checks, safety approvals, import permissions, export permissions, tax registrations, and consumer disclosures before listing or supplying them.
Journcart may remove listings, block keywords, restrict categories, request documents, report suspected illegality, suspend accounts, cancel orders, hold payments, or refuse support for transactions involving prohibited or restricted items.
The absence of an item from a prohibited list does not mean it is allowed. Journcart may restrict any item that it reasonably considers risky, unlawful, harmful, misleading, or unsuitable for the marketplace.
When placing an order, the buyer is responsible for reviewing the product, seller, quantity, variations, shipping method, delivery address, delivery region, price, currency, subtotal, shipping total, total amount, order messages, and any seller-specific terms displayed before checkout.
An order may be pending, processing, shipped, completed, cancelled, disputed, refunded, or otherwise updated according to marketplace records, seller action, payment status, delivery status, buyer confirmation, dispute outcome, or automated platform rules.
Prices may be displayed in store currency, user currency, reporting currency, or another supported currency. Currency conversion, rounding, payment-provider rates, taxes, and service charges may affect the final amount charged or settled.
Journcart may cancel, correct, reverse, or review orders affected by obvious pricing errors, stock errors, duplicate checkout, payment failure, unauthorised activity, system error, listing removal, shipping impossibility, fraud signals, policy breach, or legal concerns.
Buyers and sellers should keep order communications inside Journcart where possible so that messages, evidence, quotations, shipping details, payment details, and dispute records can be reviewed if a problem arises.
Journcart may support payment through third-party payment processors, mobile money providers, banks, cards, internal CRIB account records, gift cards, credits, refunds, or other payment methods made available from time to time.
A CRIB account or platform balance is a platform record used to support marketplace payments, refunds, settlements, transfers, and withdrawals. Unless Journcart expressly states otherwise in a separate licence-backed product, it is not a bank account, savings account, investment product, insurance product, or deposit-taking service.
Funds connected to an order may be held pending payment confirmation, fraud review, delivery progress, buyer confirmation, automatic confirmation, dispute review, chargeback risk, refund processing, or settlement timing. Sellers may receive the net settlement amount after platform fees, refunds, reversals, chargebacks, taxes, penalties, or other lawful deductions.
Withdrawals may be subject to verification, account review, minimum and maximum limits, payment-provider rules, destination validation, mobile money or bank availability, compliance screening, fraud checks, support review, and processing delays outside Journcart’s control.
Users must not use Journcart, CRIB accounts, gift cards, payment cards, refunds, withdrawals, quotations, or orders for money laundering, fraud, unauthorised transfers, payment testing, cash advances, sanctions evasion, fake orders, circular transactions, or chargeback abuse. Journcart may hold, reverse, recover, or report funds where required or reasonably justified.
Sellers are responsible for configuring accurate shipping methods, shipping regions, delivery estimates, shipping costs, delivery partners, pickup options, and delivery limitations for their products and stores.
Buyers are responsible for providing complete and accurate delivery information, including recipient name, phone number, email address, country, region, address, and any instructions needed for delivery. Journcart and sellers may not be responsible for losses caused by incorrect or incomplete delivery information.
Delivery estimates are estimates only unless expressly guaranteed in writing. Delays may be caused by seller handling time, courier issues, customs, weather, strikes, public holidays, wrong addresses, failed contact, payment review, security checks, technical issues, or force majeure events.
A shipped order may require buyer confirmation when the product is received. If the buyer does not confirm or dispute within the applicable confirmation window, Journcart may automatically confirm delivery and release settlement to the seller according to platform rules.
Risk of loss, return shipping responsibility, delivery evidence, failed delivery, refused delivery, damaged delivery, and collection requirements may depend on seller policy, courier rules, payment-provider rules, product type, dispute evidence, and applicable law.
Cancellations, returns, refunds, replacements, repairs, partial refunds, and other remedies may depend on order status, seller policy, product category, payment status, delivery status, buyer confirmation, dispute evidence, hygiene or safety restrictions, courier rules, and applicable law.
A buyer should report problems promptly and provide clear evidence, such as product photos, videos, packaging photos, delivery records, messages, order details, quotation details, payment records, and a description of the issue. A seller should respond promptly and provide relevant evidence such as listing details, stock records, shipping proof, communication records, and product condition information.
Journcart may review orders, listings, messages, images, videos, delivery data, store history, buyer history, payment history, timing, policies, and other evidence to support a fair outcome. Journcart may close a dispute if requested information is not provided within a reasonable time.
Possible outcomes may include cancellation, return of the item, replacement, repair, partial refund, full refund, release of funds to the seller, payment hold, store warning, account restriction, delivery-provider referral, or another remedy Journcart considers reasonable and lawful.
Users must not abuse cancellations, refunds, chargebacks, return claims, disputes, or delivery confirmations. False claims, manipulated evidence, threats, harassment, non-return of refunded goods, and attempts to bypass the dispute process may lead to restrictions and recovery of costs.
Journcart may allow sellers to create auction versions of products and may allow users to bid on eligible auction listings. Auction details, start times, end times, bid history, bid count, current bid, availability, and winner records are based on platform records.
A bid is a serious commitment to buy if it becomes the winning bid. You must not place fake bids, shill bids, automated abusive bids, bids you cannot honour, bids using another person’s account, or bids designed to manipulate price, ranking, scarcity, or auction outcome.
Sellers must not cancel auctions unfairly, remove auction items after meaningful buyer reliance, bid on their own auctions through other accounts, manipulate auction visibility, misstate product condition, or avoid successful auction obligations without a valid reason.
Journcart may impose buyer bid penalties, store auction penalties, temporary restrictions, permanent restrictions, payment holds, order cancellation, or other enforcement where a bidder fails to complete a valid winning purchase or where a seller abuses auction tools.
Journcart may extend, cancel, remove, review, or correct an auction affected by technical error, fraud, suspicious bidding, policy breach, product removal, illegal listing, system outage, or other marketplace-risk issue.
Sellers and stores may use deal tools, promotional prices, product tags, event pages, story media, ad placements, paid views, coverage targeting, buttons, banners, and related promotional tools where available.
Promotions must be accurate, lawful, and not misleading. A seller must not create false discounts, fake old prices, expired offers, unavailable event products, misleading countdowns, bait-and-switch listings, deceptive ad links, or promotional content that misrepresents stock, price, delivery, event dates, or product condition.
Events must include accurate event names, descriptions, media, start times, end times, linked products, and promotional details. Journcart may remove expired events, expired event product tags, orphaned promotion clones, invalid story ads, or promotions that no longer match active event records.
Paid ads, story promotions, coverage settings, and paid views are subject to availability, review, technical delivery, country targeting, impression/view counting rules, content restrictions, and marketplace policy. Journcart does not guarantee a particular number of sales, followers, messages, clicks, orders, or revenue from a promotion unless expressly agreed in writing.
Journcart may reject, pause, remove, refund, partially refund, or decline to refund promotional products depending on whether the service was delivered, whether the content breached policy, whether third-party systems failed, whether the store caused the issue, and any applicable paid-service terms.
Journcart may allow users to submit quotation requests for products, quantities, categories, subcategories, additional information, countries, documents, or other requirements and may allow stores or sellers to respond with quotations.
A quotation is based on the information available at the time it is issued. Unless expressly accepted and converted into a confirmed order or written contract, a quotation may expire, change, be withdrawn, or require further confirmation of stock, price, delivery, taxes, specifications, and payment terms.
Users must provide accurate quotation request details and must not submit fake requests, spam requests, unlawful requests, requests designed to harvest seller information, or requests for prohibited goods or services.
Sellers responding to quotation requests must ensure that quoted amounts, currencies, item details, delivery assumptions, validity periods, and limitations are clear and not misleading.
Journcart may remove quotation requests or quotations that are abusive, fraudulent, unlawful, misleading, duplicate, technically broken, outside marketplace scope, or inconsistent with these Terms.
Journcart may provide messaging between buyers and stores, support messaging, contact forms, notifications, email queues, SMS queues, order messages, quotation messages, product messages, and administrative communications.
You must use messaging tools respectfully and only for legitimate marketplace, order, support, quotation, delivery, product, store, or account purposes. You must not send spam, harassment, threats, hate speech, illegal content, phishing links, malware, deceptive payment instructions, off-platform scam requests, or content that violates another person’s rights.
Journcart may review, filter, moderate, assign, archive, delete, restrict, or use message and support records to provide customer support, detect fraud, resolve disputes, enforce policies, improve safety, and comply with legal obligations.
Notifications, email, SMS, push messages, and in-app messages may be delayed, blocked, filtered, or unavailable due to device settings, network issues, provider failures, incorrect contact details, spam filters, system queues, or third-party limits.
Users should avoid sharing passwords, PINs, card security codes, sensitive documents, or unnecessary private information in messages. Journcart may never ask for some sensitive credentials through ordinary chat.
Journcart may allow users to leave feedback, star ratings, product reviews, store ratings, wishlist entries, watchlist entries, following records, reminders, and other preference or engagement records.
Feedback must be honest, relevant, and based on a real experience. Users must not post fake reviews, paid undisclosed reviews, retaliatory reviews, abusive reviews, competitor sabotage, private information, discriminatory content, or reviews that misrepresent a transaction.
Journcart may remove, hide, edit formatting, restrict, or reject reviews, ratings, feedback images, wishlist records, watchlist records, or following activity that appears fraudulent, abusive, irrelevant, unlawful, manipulated, technically broken, or inconsistent with marketplace standards.
Store follower counts, star totals, review totals, product views, order counts, watchlists, wishlists, rankings, and engagement indicators may be estimated, delayed, corrected, filtered, or reset to protect integrity and account for fraud, abuse, duplicates, technical errors, or policy enforcement.
Wishlists, watchlists, reminders, and following tools are convenience features only. They do not reserve stock, lock prices, guarantee auction outcomes, guarantee event availability, or require a seller to honour a later purchase unless a confirmed order or binding agreement exists.
You are responsible for all content you upload, submit, publish, send, or display through Journcart, including product images, videos, story media, event images, banners, logos, profile photos, product descriptions, store descriptions, messages, reviews, documents, quotation information, and support attachments.
You confirm that you own or have permission to use and share your content and that it does not infringe copyright, trademarks, design rights, patents, trade secrets, privacy rights, image rights, personality rights, confidentiality obligations, or other rights of another person.
You grant Journcart a non-exclusive, worldwide, royalty-free licence to host, store, process, resize, crop, compress, display, transmit, reproduce, promote, and otherwise use your content as needed to operate, secure, moderate, market, and improve the Services.
Journcart, its logos, designs, software, page layouts, marketplace tools, icons, documentation, help materials, and platform content are owned by Journcart or its licensors. You may not copy, sell, licence, reverse engineer, scrape, or create derivative works from them except as allowed by platform tools or written permission.
Rights owners may contact Journcart with a notice identifying the protected work or mark, the allegedly infringing content, the listing or account involved, contact information, and a good-faith statement of ownership or authority. Journcart may remove or restrict content while reviewing a complaint and may restrict repeat infringers.
Journcart may collect, generate, store, use, share, and retain information needed to operate the Services, including account information, store information, delivery information, contact information, messages, device/session data, payment and settlement records, CRIB account records, order history, quotations, product uploads, support requests, verification data, security logs, and user preferences.
Personal data may be used to provide the Services, process transactions, verify accounts, prevent fraud, secure the platform, support customers, enable delivery, manage payments and withdrawals, comply with law, resolve disputes, enforce policies, improve features, and send service-related communications.
Sellers who receive buyer personal data through Journcart must use it only for the relevant order, delivery, customer support, tax, legal, or marketplace purpose. Sellers must not misuse buyer data, sell it, spam buyers, contact buyers outside the transaction without a proper basis, or expose it to unauthorised persons.
Users may have rights to access, correct, delete, restrict, or object to certain uses of personal data where applicable law provides such rights. Some records may be retained where needed for legal, fraud-prevention, tax, accounting, dispute, safety, or legitimate business reasons.
A separate Privacy Policy may give more detail on data practices. If there is a conflict between these Terms and the Privacy Policy about privacy-specific matters, the Privacy Policy should control unless these Terms impose additional marketplace conduct obligations.
Journcart may charge fees for store creation, store subscriptions, product allowances, ads, story promotions, product boosts, event promotions, seller verification, platform services, payment processing support, withdrawals, refunds, order settlement, or other paid features made available from time to time.
Fees may vary by service code, plan, country, currency, billing period, tax treatment, promotion, exchange rate, account type, or market availability. Journcart may update fees prospectively, subject to applicable law and any specific paid-service commitment already accepted.
Users are responsible for taxes, duties, levies, withholding, reporting, invoices, receipts, and business records applicable to their activity unless Journcart expressly states that it will collect or remit a specific tax on their behalf.
Gift cards, credits, coupons, refunds, promotional balances, and account balances may be subject to expiry, paid status, fraud review, country restrictions, currency rules, service restrictions, and non-transferability rules. They may not be redeemable for cash except where required by law or expressly allowed by Journcart.
Billing records, ledgers, transaction histories, platform charges, payment references, tax amounts, exchange rates, and settlement records may be corrected where a technical, arithmetic, currency, duplicate, fraud, chargeback, refund, or reconciliation error is identified.
Withdrawal requests may be approved, rejected, cancelled, paid, or delayed depending on account status, available balance, verification, destination information, payment channel, fraud review, dispute status, refund risk, chargeback risk, compliance requirements, and administrative review.
Refunds may be returned to the original payment method, CRIB account, platform balance, gift card, store balance, or another method Journcart considers reasonable and supported. Third-party payment processors, banks, mobile money providers, and card schemes may affect timing and availability.
Users must not file false chargebacks, payment disputes, fraud reports, reversal requests, or duplicate refund requests. Journcart may contest chargebacks and provide order, message, delivery, account, transaction, device, and dispute evidence to payment providers, banks, mobile money providers, card networks, or authorities.
If a seller receives funds for an order that is later refunded, reversed, charged back, cancelled, found fraudulent, or found to breach policy, Journcart may recover the amount from future payouts, CRIB balance, store balance, account balance, payment method, refunds due, debt collection, legal claim, or other lawful means.
If a buyer receives a refund and later receives, keeps, uses, resells, or refuses to return the item without authorisation, the buyer may be required to return the item, repay the refund, cooperate with recovery, or face account restrictions.
Journcart may include tools for career details, service provider profiles, consultation or repair-related categories, IPP document submissions, contact forms, support tickets, uploaded documents, and other service-related submissions.
You are responsible for ensuring that documents, licences, certifications, credentials, career details, professional claims, service descriptions, and uploaded files are accurate, lawful, current, and submitted with proper authority.
Journcart may review, store, process, forward, restrict, delete, or request clarification for documents and submissions where needed to provide support, verify information, process requests, prevent fraud, comply with law, or enforce these Terms.
You must not upload forged documents, malware, unauthorised personal data, confidential third-party records, unlawful content, infringing material, misleading credentials, or files intended to disrupt, overload, exploit, or compromise the Services.
Unless expressly agreed in writing, Journcart does not guarantee employment, professional opportunities, service bookings, document approval, intellectual property registration, certification recognition, or successful completion of any third-party process connected to submitted information.
You must use Journcart in good faith and in compliance with applicable law. You must not interfere with the Services, overload systems, scrape data without permission, reverse engineer restricted areas, bypass security, probe vulnerabilities, introduce malware, use bots abusively, manipulate search or rankings, launder money, facilitate fraud, or help others breach these Terms.
You must not manipulate orders, auctions, bids, quotations, reviews, ratings, followers, watchlists, wishlists, views, ads, store metrics, notification counters, messages, product rankings, payment flows, refunds, withdrawals, or platform fees.
You must not use Journcart to harass, threaten, defame, exploit, discriminate, impersonate, phish, dox, spam, evade enforcement, evade fees, evade taxes, evade payment rules, or transfer risk to another user unfairly.
Journcart may use automated systems, manual review, user reports, payment-provider feedback, delivery-provider feedback, device/session records, transaction records, and other risk signals to detect and respond to abuse.
Security research, automated access, crawling, scraping, load testing, vulnerability testing, integration testing, or use of unpublished APIs requires prior written permission from Journcart.
Journcart works to provide reliable Services, but does not guarantee that the Services will always be available, uninterrupted, secure, error-free, compatible with every device, browser, network, payment method, delivery partner, hosting provider, or third-party service.
The Services may depend on third-party services such as hosting providers, payment processors, mobile money providers, banks, card networks, email providers, SMS providers, analytics tools, couriers, delivery partners, maps, image/video tools, or external websites. Journcart is not responsible for third-party acts, omissions, outages, fees, rules, or terms except where required by law.
Journcart may update, redesign, suspend, remove, limit, replace, or discontinue any feature, page, category, tool, subscription, package, price, promotion, integration, payment method, delivery method, support channel, or policy at any time, subject to applicable law and any specific paid-service commitment.
Some features may be experimental, beta, limited-release, or provided for testing. Such features may be unstable, changed quickly, unavailable to some users, or removed without notice.
External links, seller websites, payment pages, courier pages, social media pages, and third-party resources are provided for convenience only. Users should review the applicable third-party terms and privacy notices before using them.
Journcart may investigate accounts, stores, listings, products, messages, payments, CRIB accounts, withdrawals, refunds, reviews, auctions, bids, quotations, events, ads, stories, documents, and orders where it reasonably suspects fraud, legal breach, safety risk, payment risk, intellectual property infringement, abusive behaviour, or policy breach.
Enforcement actions may include warnings, content removal, listing demotion, feature limits, order cancellation, refund or reversal, payment holds, settlement holds, withdrawal rejection, store restrictions, account suspension, account termination, support escalation, reporting to authorities, or civil recovery of losses.
Journcart may act immediately without prior notice where delay may increase risk to users, the public, payment systems, delivery partners, platform security, legal compliance, evidence preservation, or marketplace integrity.
Where appropriate, Journcart may provide an opportunity to respond, appeal, correct information, complete verification, or resolve an issue. Journcart is not required to reinstate accounts, stores, content, funds, features, or listings where it reasonably determines that risk remains.
Termination or suspension does not remove obligations already incurred, including payment obligations, delivery obligations, refund obligations, tax obligations, dispute cooperation, confidentiality, intellectual property obligations, recovery rights, and liability for prior conduct.
The Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. Journcart does not guarantee that every listing, seller, buyer, message, payment method, courier, quotation, auction, promotion, event, or support outcome will meet your expectations.
Journcart does not manufacture, inspect, store, own, or control most third-party products listed by sellers. Sellers are responsible for product quality, description, safety, legality, warranties, after-sales obligations, and compliance with applicable laws.
Journcart does not guarantee the truth or accuracy of user content, store content, product content, messages, reviews, ratings, follower counts, availability claims, delivery estimates, quotation claims, promotional claims, or third-party links, although it may review and moderate them.
Nothing in these Terms excludes liability that cannot lawfully be excluded. Where liability can be limited, Journcart’s liability is limited to the amount you paid to Journcart for the specific paid platform service giving rise to the claim, or the minimum amount required by applicable law, whichever is greater.
Journcart is not liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, loss of goodwill, loss of data, lost sales, business interruption, or third-party losses except where applicable law says such liability cannot be excluded.
To the fullest extent permitted by law, you agree to indemnify and hold Journcart, its owners, directors, employees, contractors, administrators, service providers, and affiliates harmless from claims, losses, damages, liabilities, penalties, fees, costs, and expenses arising from your use of the Services, your content, your store, your listings, your products, your services, your messages, your documents, your payments, your withdrawals, your refunds, your disputes, or your breach of these Terms.
Seller indemnity includes claims related to product defects, unsafe goods, counterfeit goods, intellectual property infringement, misleading listings, tax obligations, delivery failures, warranty claims, after-sales issues, illegal goods, regulatory breaches, and customer claims connected to seller products or services.
Buyer indemnity includes claims related to false disputes, chargeback abuse, non-payment, misuse of refunds, unauthorised account activity caused by buyer negligence, unlawful purchase requests, abusive conduct, and misuse of seller or platform information.
This indemnity applies even if Journcart helps facilitate the transaction, payment, message, quotation, delivery record, event, ad, refund, or dispute, except to the extent a loss is caused by Journcart’s own unlawful conduct or liability that cannot legally be limited.
Journcart may control the defence of claims involving platform interests and may require reasonable cooperation from the user involved.
These Terms are governed by the laws of Uganda unless mandatory consumer law in another jurisdiction provides rights that cannot be waived.
Before starting formal proceedings against Journcart, you agree to first contact Journcart through the available support or contact channels and give Journcart a reasonable opportunity to investigate and respond, except where urgent legal relief is required.
Buyer-seller disputes should first be handled through the order, message, return, refund, or dispute tools provided by Journcart where available. Journcart may support resolution but is not required to act as a court, arbitrator, insurer, courier, or guarantor of either party’s performance.
If a dispute with Journcart cannot be resolved informally, the courts or competent authorities of Uganda will have jurisdiction, subject to any mandatory legal rights that apply to a consumer or user in another jurisdiction.
Complaints involving data protection, consumer protection, payment providers, delivery providers, intellectual property, or regulated services may also be handled through the appropriate regulator, authority, provider, or legal process where applicable.
Journcart may update these Terms from time to time to reflect new features, legal requirements, payment rules, marketplace policies, pricing changes, security needs, operational changes, or risk controls.
The version number and effective date identify the current version displayed on the platform. Journcart may notify users of material changes through the website, account notices, email, SMS, support channels, or other reasonable means.
Unless a shorter period is required for legal, security, fraud-prevention, urgent operational, or regulatory reasons, material changes will apply prospectively from the effective date stated on the updated Terms.
Your continued use of the Services after updated Terms become effective means you accept the updated Terms. If you do not agree with updated Terms, you must stop using the Services and may close your account subject to any outstanding obligations.
Archived versions, if kept, are for reference only. The active version controls current platform use unless Journcart expressly agrees otherwise in writing.
If any part of these Terms is found invalid, unlawful, or unenforceable, the remaining parts remain in effect and the invalid part will be interpreted or replaced in a way that most closely reflects the original purpose while remaining lawful.
Journcart’s failure or delay in enforcing any right, policy, or provision does not waive that right, policy, or provision. A waiver must be in writing and applies only to the specific instance identified.
You may not assign or transfer your account, store, rights, obligations, CRIB account, balance, subscription, verification status, or these Terms without Journcart’s prior written permission. Journcart may assign or transfer its rights and obligations as part of a merger, acquisition, restructuring, sale of assets, change of control, or operation of law.
Headings and summaries are for convenience only and do not limit the full text of each section. Examples are illustrative and do not limit the general wording.
These Terms, together with policies and notices linked from them, form the agreement between you and Journcart for use of the Services, unless a separate written agreement signed by Journcart expressly overrides them for a specific service.
